TexHaul Rentals LLC – Rental Terms & Legal Policies
1. Agreement to Terms
By renting from TexHaul Rentals LLC (“Company,” “We,” “Us”), the customer (“Renter,” “You”) agrees to all terms outlined in this agreement, any signed rental contract, and all policies published on our website. These terms are legally binding and enforceable under the laws of the State of Texas.
2. Responsibility & Liability
- Renter assumes full responsibility for the trailer and its contents from the time of delivery or pickup until it is returned to TexHaul Rentals.
- Renter is liable for all damage, loss, theft, misuse, or excessive wear, regardless of cause.
- Responsibility includes actions of employees, contractors, guests, or any third party.
- Any damage requiring repair, restoration, or replacement will be billed to the Renter.
3. Prohibited Materials
The following are strictly prohibited unless approved in writing:
- Paint, liquids, or wet materials
- Chemicals, oils, fuels, or hazardous substances
- Batteries, tires, or regulated waste
If prohibited materials are found:
- Service may be refused
- Additional handling and disposal fees will apply
- Any resulting damage will be billed as restoration and repair, not cleaning
4. Damage, Cleaning & Restoration
- Trailer must be returned in the same condition as delivered, excluding normal wear and tear.
- Any contamination requiring scraping, grinding, repainting, or restoration will be billed accordingly.
- TexHaul Rentals has sole discretion to determine:
- Extent of damage
- Required repairs
- Cost of restoration
5. Load Requirements & Safety
- Loads must be evenly distributed and not exceed capacity (10,000 lbs payload)
- Materials must not exceed the top rail of the trailer (“level load” requirement)
- Overfilled or unsafe loads may be refused for transport
- Renter is responsible for all costs associated with correcting unsafe loads
6. Payment Authorization & Charges
- Renter authorizes TexHaul Rentals to charge the payment method on file for:
- Rental fees
- Disposal overages
- Damage, cleaning, or restoration
- Trip fees, delays, or additional services
- If payment is declined:
- Renter agrees to provide valid payment immediately upon request
- Failure to pay may result in collections and legal action
7. Post-Rental Inspection
- All trailers are inspected after return or pickup
- Photo and video documentation may be used
- Renter agrees that post-rental inspection findings are valid evidence of condition and damage
8. No Refund Policy
- All payments are non-refundable unless approved in writing
- Charges for damages, overages, or additional services are final once assessed
9. Disputes & Chargebacks
- Disputes must be submitted in writing
- Renter remains responsible for all charges during review
- Unauthorized chargebacks may result in:
- Immediate collections action
- Administrative fees ($150/hour, 1-hour minimum)
10. Rental Extensions & Continued Use
- Continued use or delayed return constitutes acceptance of all terms
- Additional rental time will be charged automatically
11. Indemnification
Renter agrees to indemnify and hold harmless TexHaul Rentals LLC from any claims, damages, or liabilities arising from use of the trailer.
12. Haul-Off Service Terms (Delivery & Pickup)
- Trailer will be delivered to the provided address and must remain in place.
- Renter may not move, relocate, or tow the trailer.
Renter must ensure:
- Clear and safe access
- Trailer is not blocked or enclosed
- Trailer is ready at scheduled pickup time
TexHaul Rentals may refuse pickup if:
- Trailer is blocked
- Load is unsafe or overfilled
- Prohibited materials are present
Additional Charges May Apply For:
- Failed pickup attempts (dry runs)
- Wait time or delays
- Repositioning or special handling
- Offloading unsafe materials
- Additional trips
If the trailer is not ready:
- Rental continues
- Additional fees apply automatically
13. Self-Service Rental Terms (Customer Tow)
Renter agrees:
- Must be 18+ with valid driver’s license
- Must have a properly equipped tow vehicle, including:
- 2-5/16” hitch
- 7-pin connection
- Brake controller
- Renter assumes full responsibility for:
- Safe towing
- Load securement
- Compliance with all traffic laws
- TexHaul Rentals is not liable for:
- Accidents, injuries, or damages during towing
- Improper use or equipment mismatch
- Any damage occurring during self-service rental is the Renter’s responsibility
14. Legal Enforcement
- This agreement is governed by Texas law
- Renter agrees to pay all costs associated with collection, including legal fees where permitted
15. Policy Updates
TexHaul Rentals LLC reserves the right to update these policies at any time. Continued use of services constitutes acceptance of updated terms.
